Homicide north of Poteet



Monday night an arrest was made for murder on Ashford Circle off Stacey Road, 8 miles northwest of Poteet.

A 17-year-old Devon McKinney from Somerset was shot and killed allegedly by Dustin De La Vega, age 21, of Ashford Circle, Poteet.

The call came in to the Atascosa County Sheriff’s Department shortly before 10 p.m. Monday night.

First Deputy on scene was Clint Luckett.

Witnesses at the scene were able to detain the suspect after the shooting. Deputy Luckett took him into custody. Deputy Sheriff George Lopez and Sergeant Paul Schneider arrived at scene to assist.

Witnesses and suspect stated that the suspect (De La Vega) was selling drugs from his residence. McKinney arrived to purchase an ounce of marijuana. McKinney pulled a gun on De La Vega in attempt to rob him.

A gunfight ensued and McKinney was shot and killed. Both parties fired their guns during the shootout.

McKinney was pronounced dead at scene by J.P. Pct. 2 Kyle Bradley who ordered an autopsy. De La Vega was booked into the Atascosa County Jail and charged with Murder. Lt. Investigator Max Peralta is heading up the investigation and was assisted at the scene by Lt. Wayne Stratton and Sgt. Investigators Albert Garza, Daniel Gamez and Jesse Martinez. Bond on De La Vega was set at $800,000 by J.P. Pct 4 Jackie Bodden.

Sheriff David Soward stated the case is still under investigation but no further arrests are expected. The sheriff also explained that under Texas law one cannot use selfdefense as a defense if they are involved in criminal activity. The sheriff stated the case will be forwarded to the District Attorney’s Office and subsequently to a grand jury.

Investigators recovered both weapons and numerous pieces of evidence at the scene.
