Present were three commissioners, Lonnie Gillespie, (Precinct 1); William “Bill” Torans, (Precinct 2); and Bill Carroll (Precinct 4). Freddie Ogden, (Precinct 3) was unable to attend.

After call to order of the Regular Meeting of the Commissioners Court, and public comments, Judge Bautista called on Atascosa County Fire Marshal Charles Garris to discuss a Flood Damage Prevention Ordinance. No action was taken on this item by the Commissioners Court and Charles Garris at this time. After additional information, it will be reviewed at the Special Meeting on Monday, January 28, 2013.

Next Charles Garris entered into the Commissioner’ Court minutes the Volunteer Fire Department Agreements for 2012.

On the agenda next, Victor Uvalle was called on for discussion regarding Texas Association of Counties Risk Management Pool (TAC RMP) Workers’ Compensation Program and Political Subdivision Workers’ Compensation Alliance. No action was taken at this time.

Attorney Thomas Cate was on the agenda next with three different properties that were struck off at a tax foreclosure sale.

First property he asked for appropriate action concerning was a bid for Property ID 30891 in Poteet. An offer on the subject property of $3,000.00 was made by Hector Rivera. Bid was accepted.

Second property appropriate action was sought concerning was a bid for Property ID 318983 in Atascosa County. An offer on the subject property of $5,000.00 was made by Teri M. Zavala and Alejandro Lopez Zavala. Bid was accepted.

The third property appropriate action was called for was a bid for Property ID 28943 in Pleasanton. An offer on the subject property in the amount of $5,500.00 was made by Carlos M. Lopez. Bid was accepted.

On the agenda next was Justice of Peace Betty Caballero, Pct. 1, requesting appropriate action concerning personnel. She requested the hiring of Naomi Reeves as a part-time clerk at the rate of $7.75/hour. Employment was approved.

JP Caballero then requested appropriate action concerning purchase of an IPAD, from Wal-Mart, to be paid out of the Justice Court Technology Fund in the amount of $599.00. Request was approved.

Next on the agenda was Justice of Peace Jackie Bodden, Pct. 4, requesting action concerning purchase of Tablet, in the amount of $1,234.90, to be paid out of the Justice Court Technology Fund. Provider of the Tablet is Altex Electronics, Ltd. Request was approved.

JP Bodden then requested action concerning invoice from Robbie’s Computer Service to be paid out of the Justice Court Technology Fund in the amount of $120.00 for a service call for virus removal. Request was approved.

On the agenda next was District Attorney Rene Peña requesting appropriate action concerning personnel. Requested was payroll increases for three employees, in the following amounts: Margarita Pol: $1,000.00; Teresa Reyes: $711.00; Carrie Moy: $2,400.00. Request was approved.

D.A. Peña then requested appropriate action concerning Emergency Budget Amendment. Funds in the amount of $25,000.00 from the D.A. Chapter 59 Forfeiture Fund. Funds to be used to establish Child Advocacy Center. Request was approved.

Next on the agenda was Sheriff David Soward requesting hiring of three personnel.

First was the hiring of Raul Guerra as a Corrections Officer at the pay rate of $2,756.00/month with $120.00/month uniform allowance. Request was approved.

Next was Krista Springer as a Dispatcher at the pay rate of $2,756.00/month, $120.00 uniform allowance. Request was approved.

Timothy Sawicki as a Deputy Sheriff at the pay rate of $3,112.00/month; $120.00 uniform allowance. Request was approved.

Sheriff Soward then requested appropriate action concerning a report to the Commissioners’ Court regarding Senate Bill 1074, Racial Profiling recap for 2012. There were 314 stops with 302 citations, 10 arrests, (2 of both). Race/ethnicity: Blk – 8; Hisp. – 166 and Wht. – 137.

On the agenda next was County Treasurer Laura Pawelek requesting appropriate action concerning Treasurer’s Report Order for December, 2012, to be published in the Pleasanton Express. Request was approved.

Mike Lambaria, Atascosa County Veterans Service was on the agenda next requesting action concerning personnel. He was seeking the employment of David Guerrero as a driver at the pay rate of $8.50/hour. Request was approved.

Next on the agenda was Loretta Holley, Atascosa County Tax Assessor-Collector, requesting appropriate action concerning personnel. She requested the hiring of Shirley Yow as a Deputy Tax Collector at the pay rate of $2,252.00/month. Request was approved.

On the agenda next was Atascosa County Auditor Ray Samson requesting appropriate action concerning correction of typo on 2013 salaries list approved on December 26, 2012. Request was approved.

Ray Samson then requested authority to advertise for bids on road materials for all precincts. Request was approved.

Requested next by Ray Samson was for authority to advertise for bids on gas and diesel for all precincts. Request was approved.

Authority to advertise for bids on hauling for all precincts was then sought by Ray Samson. Request was approved.

Ray Samson then requested for authority to advertise for bids on culverts for all precincts. Request was approved.

Requested next by Ray Samson was authority to advertise for bids on copy paper. Request was approved.

Atascosa County Commissioner Lonnie Gillespie, Pct. 1, was on the agenda next requesting appropriate action concerning approval of Final Plat for Eagle Ford Drive Industrial Park: Block 1, Block 2 and Block 3. Request was approved.

The office of Freddie Ogden, Atascosa County Commissioner, Pct. 3, then requested appropriate action concerning personnel. The hiring of Adolfo Rodriguez as a Precinct 3 Worker at the pay rate of $2,450.00/month was requested. Request was approved.

The office of Freddie Ogden then requested approval of Seitel Data, Ltd.’s request to conduct a seismographic survey, including the right to ingress and egress for such purposes,across Atascosa County and more fully desccribed as: A33033–SS Farms Lot PT4990 and 4991 4.25. This was for EOG Resources and would take place, approximately, during the period of February through April. Request was approved.

Bill Carroll, Atascosa County Commissioner, Pct. 4, then requested appropriate action concerning approval of Construction Entrance off CR 415 for EOG Resources. Request was approved.

Comm. Bill Carroll then requested action concerning damages for Atascosa County property in McMullen County from Chesapeake Operating. Atascosa County received payment of $5,175.00 to satisfy request and was advised that, likely, Atascosa County would be receiving royalty checks for their part in a pool on well or wells being drilled on the property. Payment request was approved.

Comm. Bill Carroll then requested appropriate action concerning appointment of Representative as Lobbyist for County Court at Law in Austin on behalf of Atascosa County. Request was approved.

Next on the agenda Judge Bautista requested approval of Commissioners Court Minutes for previous meetings (November, 2012). Request was approved.

Judge Bautista then requested appropriate action concerning Capital Outlay Expenditure Requests.

Sheriff David Soward requested purchase of five 2013 Chevrolet Tahoes,equipped, at the cost of $128,796.00. $3,796.00 of the cost coming out of the Drug Forfeiture Fund. The balance was already budgeted out of capital outlay fund. Request was approved.

Requested next by Sheriff Soward was Software as a Service and Professional Services Agreement (program upgrade) from Tyler Technologies costing $148,480.00. Item had been already budgeted. Request was approved.

Rex Newman, Atascosa County Health Inspector requested the purchase of a computer from Altex Computers at a cost of $1,524.00. Also requested the purchase of a sheet fed scanner, laser printer and equipment from Office Depot in the amount of $988.96. These were unexpected, necessary, capital items. Requests were approved.

. Next, Judge Bautista requested purchase of an HP LaserJet Pro All-In-One Printer, Copier, Scanner, Fax from Office Depot at a cost of $269.99. Request was approved.

Judge Bautista then asked for order of bills to be paid. Meeting was then adjourned.

Judge Bautista reminded those present of the next Special Meeting to be held beginning at 9 a.m., on Monday, January 28, 2013.
