Commissioners, Lonnie Gillespie, (Precinct 1); William

“Bill” Torans, (Precinct 2); Freddie Ogden, (Precinct 3) & Bill Carroll,

(Precinct 4).

After call to order of the Regular Meeting of Commissioners’ Court, Judge Bob Hurley asked for public comments.

Leonard Gonzales spoke regarding the condition of roads, namely CR 430 and other roads in that area where more work needed to be done to repair them.

Aurora Gonzales then discussed the same CR 430 area where roads were dangerous due to needed repairs, as she’s driving her school bus route in that vicinity.

Ben Garza, Senior Certified Business Advisor at UTSA, along with Mark Smith, a principal with J&G Systems LTD, requested appropriate action concerning 5 acre tract of land for development. Commissioners’ agreed to continued discussion.

Judge Bob Hurley requested appropriate action concerning appointment of Stuart Knowlton as Atascosa County Appraisal District Representative for a period of two years, 2016-2017. Appointment was granted.

Judge Hurley then requested appropriate action concerning Adoption of Resolution appointing the County Appraisal District Representative for a period of two years, 2016-2017. Request was approved.

Stuart Knowlton gave an update regarding Atascosa County Appraisal District.

Judge Hurley requested appropriate action concerning an Interlocal Agreement between Lubbock County acting through the Regional Public Defender for Capital Cases (the “PD”), and Atascosa County (“Participant”), a political subdivision of the State of Texas, (also individually, a “Party” or, Collectively, the “Parties”). This agreement is made Pursuant to the Fair Defense Act, Texas Code of Criminal Procedure 26.044(Ib), and Texas Government Code Chapter 791. Request was granted.

Judge Hurley then requested appropriate action concerning Approval of Resolution to apply for 2016 Indigent Defense Grant Program and for County Judge to sign the resolution. Request was approved.

Loretta Holley, Atascosa County Tax Assessor- Collector, requested appropriate action concerning the end of 90 day benefit waiting period for Rosa Garza, Deputy TAC Clerk with an effective date of coverage being October 13, 2015. Request was granted.

Loretta Holley then requested appropriate action concerning the end of 90 day benefit waiting period for Mary Jane McIntyre, Deputy TAC Clerk with an effective date of coverage being October 13, 2015. Request was granted.

Laura Pawelek, Atascosa County Treasurer, requested appropriate action concerning Treasurer’ Report Order for September, 2015. Request was approved.

The Office of Rene Peña, requested appropriate action concerning the employment of Britney Durham as a Part-Time – Temporary Clerk, beginning 10-13-2015 @ $12.50 per hour, to be paid from DA Chapter 59 Forfeiture Fund. Request was granted .• Ray Samson, Atascosa County Auditor, requested appropriate action concerning Emergency Budget Amendment: Indigent Health – Department 050, Account #050- 400-627, Med. Expense Def. $85,548.22. Amount under-budgeted for Indigent Health because of Fund Year Differences. Matches amount required by state. Request was approved.

Molly Solis, Assistant County Attorney and Comm. Bill Torans, Pct. 2, requested appropriate action concerning a special platting exception pursuant to Article 4.5, Atascosa County Subdivision Regulations, for a conveyance from Dixie Trammel to Jacob Grothues. Request was granted.

Comm. Torans, Pct. 2, requested appropriate action concerning Benton City Water requesting extension of water lines to both Mann Rd. and Rogers Rd. No action at this time.

Comm. Bill Carroll, Pct. 4, requested appropriate action concerning personnel. He requested benefits to begin on completion of 90 day waiting period for Oscar Portales, on October 13, 2015. Request was granted.

Comm. Carroll then requested appropriate action concerning request for a road bore on CR 339 for Atlas Eagle Ford Operating, LLC. Request was approved.

Comm. Carroll asked for appropriate action concerning request for a road bore on CR 340 for Atlas Eagle Ford Operating, LLC. Request was granted.

Comm. Carroll then requested appropriate action concerning temporary single 3” poly waterline on CR 407 for Select Energy Services. Request was approved.

Loretta Holley, Tax Assessor-Collector requested appropriate action concerning her continuing education transcript, meeting education requirements for the period, 1-1-2015 – 10-2-2015. Total hours for year were 28.75. Request was approved.

Judge Hurley requested appropriate action concerning entering into Commissioners’ Court minutes, Proclamation proclaiming the month of October, 2015, as Czech Heritage Month in the SPJST. Request was granted.

Judge Hurley then requested appropriate action concerning Emergency

Budget amendment to fund IT Department in 2015 that was approved to begin in 2016. Starting it now will help reduce IT costs remaining in 2015. Request was approved.

Judge Hurley requested appropriate action concerning personnel. He requested the employment of Justin Vasquez as a Full-Time IT Director, with an annual salary of $54,000.00, beginning November 9, 2015. Request was granted.

Capital Outlay Requests:

Judge Hurley requested appropriate action concerning a Capital Outlay request for a replacement computer for the Law Library from Wal-Mart online in the amount of $348.96. Request was approved.

Janice Ruple, Elections Administrator requested appropriate action concerning purchase of 2 scanners, Epson DS 510 and installation from Vista in the amount of $1,006.00. Request was granted.

Orlando Carrasco, Justice of the Peace, Pct. 3, requested appropriate action concerning purchase of PC equipment with installation from Altex Computers & Electronics at a cost of $1,216.95. Request was approved.

Ray Samson, County Auditor, requested appropriate action concerning purchase of a new computer from Altex Computers & Electronics at a cost of $1,239.95. Request was granted.

Commissioners’ Court then went into Executive Session regarding real property and personnel matters.

Commissioners’ Court resumed Open Session.

Commissioners’ Court decided to continue negotiations regarding real property and proceed as discussed about personnel matters.

Judge Hurley asked for bills to be paid.

Honorable Atascosa County Judge Bob Hurley mentioned to those present that the next Regular Meeting of Commissioners’ Court would be on Monday, October 26, 2015, beginning at 9:00 a.m.

Judge Hurley mentioned to those in attendance that the funeral services for Norman Porter would be held at 2:00 in the afternoon, today, at the Church of Christ in Pleasanton. Norman served as chairman of the Atascosa County Historical Commission since 2003 and had resigned as chairman on December 8, 2014.
